Terms of Use

1. Acceptance of Terms

By accessing or using the Aztec Tacos website at aztectacos.ca (the “Website”), you agree to be bound by these Terms of Use (“Terms”), our Privacy Policy, our Cookie Policy, and our Refund Policy. If you do not agree with any part of these Terms, you must discontinue use of the Website immediately.

These Terms constitute a legally binding agreement between you and Aztec Tacos Inc. (“Aztec Tacos,” “we,” “us,” or “our”), a corporation operating in the Province of Ontario, Canada.

2. Eligibility

You must be at least thirteen (13) years of age to use this Website. To place an online order or make a payment, you must be at least eighteen (18) years of age, or the age of majority in your province or territory of residence, and have the legal capacity to enter into a binding contract. By placing an order, you represent and warrant that you meet these requirements.

3. Website Use

This Website is provided for the purposes of browsing Aztec Tacos information, viewing our menu, placing pickup orders, making reservation requests, reading our blog, and contacting the restaurant. You agree to use the Website only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Website in any way that violates applicable federal, provincial, or local law.
  • Attempt to gain unauthorized access to any part of the Website, server, database, or connected systems.
  • Use automated tools, bots, scrapers, or scripts to access, extract, or interact with the Website without our prior written consent.
  • Interfere with or disrupt the integrity, performance, or security of the Website.
  • Submit false, misleading, or fraudulent information through any form on the Website.
  • Attempt to circumvent security measures, including CAPTCHA challenges, rate limits, or authentication controls.
  • Impersonate another person or entity, or misrepresent your affiliation with any person or entity.
  • Use the Website to transmit spam, malware, or other harmful content.
  • Reproduce, distribute, or create derivative works from Website content without written permission.

4. Menu, Pricing, and Availability

Menu items, prices, descriptions, images, promotions, and availability are subject to change without notice. Prices displayed on the Website include the base price of items; applicable taxes (Ontario HST 13%) are calculated and displayed at checkout. While we make every effort to ensure accuracy, errors in pricing or descriptions may occur. We reserve the right to correct any errors and to refuse or cancel any order placed at an incorrect price.

Server-side pricing is authoritative. Client-submitted prices, discounts, and totals are never accepted. All orders are priced by our server using the current menu and applicable taxes at the time of checkout.

Certain menu items may be available only during specific days, times, or promotional periods. Availability is managed through our system and reflected on the Website in real time when possible.

5. Online Pickup Orders

Online pickup orders are subject to the following terms:

  • Orders are confirmed only after successful online payment through Stripe. Submitting an order does not constitute a confirmed order until payment is verified.
  • You are responsible for providing accurate contact information (name and phone number at minimum) so that we may reach you regarding your order if necessary.
  • Estimated pickup times are provided as a convenience and may vary based on kitchen volume, item availability, staffing, holidays, or operational conditions.
  • Orders must be picked up at our restaurant location: 77 Montréal Road, Vanier, Ottawa, Ontario.
  • Orders not collected within sixty (60) minutes of the estimated pickup time, without prior communication, may be considered abandoned. Refunds are not available for abandoned orders except in exceptional circumstances.
  • We reserve the right to refuse, cancel, or limit any order at our sole discretion, including orders that appear to be placed in error, orders placed using fraudulent payment information, or orders for quantities that exceed our operational capacity.

6. Payments

All online payments are processed securely by Stripe. By submitting a payment, you agree to Stripe’s terms of service. All prices are quoted and charged in Canadian Dollars (CAD). Your bank or card issuer may apply additional fees for currency conversion if your card is denominated in a different currency.

7. Reservations

Reservation requests submitted through the Website are not automatically confirmed. All reservations are subject to review and confirmation by Aztec Tacos staff. A reservation is confirmed only when you receive an explicit confirmation from us. We reserve the right to decline any reservation request based on availability, party size, or operational capacity.

We ask that you arrive within fifteen (15) minutes of your confirmed reservation time. Reservations may be released to other guests if you do not arrive within this window without notifying us.

8. Allergies, Dietary Needs, and Food Safety

Our kitchen handles common allergens, including but not limited to wheat, dairy, eggs, soy, nuts, shellfish, and sesame. Cross-contact may occur. Menu item descriptions are provided for general information only and may not list every ingredient.

If you have a severe allergy or strict dietary requirement, please call us at (613) 741-9998 before ordering. While we make every reasonable effort to accommodate dietary requests and follow guest notes, we cannot guarantee that any menu item is completely free of a particular allergen.

Aztec Tacos is not liable for allergic reactions or adverse health effects resulting from food consumed from our restaurant if allergen information was not communicated to us in advance.

9. Guest Notes and Submissions

Order notes, reservation requests, contact form messages, and any other user-submitted content should contain only information relevant to the restaurant service being requested. You agree not to include:

  • Credit or debit card numbers, CVV codes, or financial account information.
  • Government-issued identification numbers (SIN, passport, driver’s licence).
  • Passwords, login credentials, or authentication codes.
  • Detailed health or medical information.
  • Offensive, abusive, threatening, or unlawful content.

We reserve the right to disregard or delete any submission that contains prohibited content.

10. Intellectual Property

All content on this Website — including but not limited to text, graphics, logos, images, photographs, menu descriptions, blog posts, page layouts, software, and the Aztec Tacos brand identity — is the property of Aztec Tacos Inc. or its content suppliers and is protected by Canadian and international copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, display, perform, or create derivative works from any content on this Website without our prior written permission. Limited personal, non-commercial use (such as viewing the menu or sharing a blog post link) is permitted.

11. Disclaimer of Warranties

The Website and all content, services, and features are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied. To the fullest extent permitted by law, Aztec Tacos disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We do not warrant that the Website will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that the results obtained from use of the Website will be accurate or reliable.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Aztec Tacos Inc., its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with:

  • Your use of or inability to use the Website.
  • Any errors, omissions, or inaccuracies in Website content.
  • Unauthorized access to or alteration of your transmissions or data.
  • Any third-party conduct on the Website.
  • Any food products prepared by the restaurant.

In no event shall our total aggregate liability exceed the amount you paid to Aztec Tacos for the specific order or service giving rise to the claim, or one hundred Canadian dollars (CAD $100.00), whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless Aztec Tacos Inc., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to your use of the Website, your violation of these Terms, or your violation of any rights of a third party.

14. Force Majeure

Aztec Tacos shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to natural disasters, pandemics, government orders, supply chain disruptions, utility failures, labour disputes, cyberattacks, or internet outages.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of Ontario for any dispute arising out of or relating to these Terms or your use of the Website.

16. Dispute Resolution

Before initiating any formal legal proceeding, you agree to first contact us at contact@aztectacos.ca and attempt to resolve the dispute informally. We will make a good-faith effort to resolve any concern within thirty (30) days of receiving your notice. If the matter cannot be resolved informally, either party may pursue remedies available under the laws of Ontario.

17. Electronic Communications Consent

By using our Website, placing an order, making a reservation, submitting a contact form, or subscribing to our newsletter, you consent to receive electronic communications from us in accordance with the Ontario Electronic Commerce Act, 2000 (ECA). You agree that all agreements, notices, disclosures, confirmations, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

You may withdraw this consent for non-transactional messages (such as newsletters) at any time. Transactional communications related to your orders or reservations may still be sent electronically as necessary to fulfil the requested service.

18. Operating Hours

Our standard operating hours are displayed on the Website and in our footer. Hours may vary on holidays, due to weather, or for other operational reasons. Changes to operating hours may be made without advance notice. We are not liable for any inconvenience caused by unannounced changes to operating hours. If we are unable to fulfil a confirmed order due to an unexpected closure, you will receive a full refund in accordance with our Refund Policy.

19. Gratuities

Gratuities (tips) are not included in online order totals and are not collected through our Website at the time of checkout. Tips are appreciated and may be offered at the time of pickup at the restaurant, at your sole discretion. Aztec Tacos does not add automatic gratuity charges to online orders.

20. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be modified, it shall be severed. The remaining provisions shall continue in full force and effect.

21. Waiver

No failure or delay by Aztec Tacos in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof. A single or partial exercise of any right, power, or privilege shall not preclude further exercise of that or any other right, power, or privilege. No waiver shall be effective unless it is in writing and signed by an authorized representative of Aztec Tacos.

22. Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. Aztec Tacos may assign, transfer, or delegate its rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, corporate reorganization, or sale of assets.

23. No Agency or Partnership

Nothing in these Terms shall be construed as creating a partnership, joint venture, agency, employment, or franchise relationship between you and Aztec Tacos. You have no authority to bind Aztec Tacos in any respect.

24. Notices

Any notice required or permitted under these Terms shall be in writing. Notices from Aztec Tacos to you may be sent by email to the address you provided, by posting on the Website, or by any other reasonable means. Notices from you to Aztec Tacos should be sent to contact@aztectacos.ca or by mail to our business address. Notices are deemed received upon delivery for hand delivery, upon sending for email (if no bounce-back is received), or upon posting for Website notices.

25. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, Refund Policy, and Accessibility Statement, constitute the entire agreement between you and Aztec Tacos regarding your use of the Website, and supersede any prior agreements, communications, or understandings, whether oral or written.

26. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting. The “Last updated” date at the top of this page will reflect the most recent revision. Your continued use of the Website after any changes constitutes acceptance of the revised Terms. If we make material changes, we will make reasonable efforts to notify you (for example, by updating the date on this page or posting a notice on the Website).
